Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and GS Digital LLC ("Company", "we", "our", or "us"), the operator of the Future You mobile application and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you may not access or use the Service.

Eligibility

To use Future You, you must:

• Be at least 18 years of age
• Be a resident of the United States
• Have the legal capacity to enter into a binding contract
• Not be prohibited from using the Service under applicable federal, state, or local laws
• Provide accurate and complete registration information
• Successfully complete identity verification as required by our banking infrastructure partner
• Maintain the security of your account credentials

Future You is not available to users under the age of 18 under any circumstances.

How Future You Works

3.1 The Behavioral Trigger System

Future You is a behavioral finance application that creates financial accountability around phone usage habits. During onboarding you configure "triggers" — specific phone behaviors you want to discourage, such as unlocking your phone or opening social media apps. Each time a trigger occurs, a small amount of money you specify is automatically moved from your linked bank account into your Future You savings vault.

Triggers are detected through Apple Shortcuts automations that you set up on your iPhone during onboarding. These automations run locally on your device and send a trigger signal to our servers when the specified event occurs. The accuracy of trigger detection depends on your device settings, iOS version, and whether your Shortcuts automations remain active. We are not responsible for missed triggers resulting from disabled or deleted automations, iOS updates, or device issues.

3.2 The Savings Vault

When you set up a vault, you choose an unlock date — the date on which your accumulated savings become available for withdrawal. Between vault creation and the unlock date, your funds are held in a savings account managed by our licensed banking infrastructure partner. Your vault balance is FDIC-insured up to $250,000.

GS Digital LLC does not hold, custody, or have direct access to your funds at any time. All funds are held exclusively by our banking infrastructure partner.

3.3 Early Withdrawal

You retain the legal right to access your funds at any time. Future You does not permanently restrict access to your money. However, the Service is designed to discourage early withdrawal through the following friction mechanism:

If you request withdrawal of funds before your vault's unlock date, a mandatory waiting period will apply before the funds are returned to your linked bank account. The duration of this waiting period is disclosed to you during vault setup and is part of the commitment you make when creating your vault.

By setting up a vault and agreeing to these Terms, you acknowledge and accept this early withdrawal waiting period. No penalty fee is charged for early withdrawal beyond the waiting period itself.

3.4 Trigger Cooldowns and Daily Limits

Each trigger has a configurable cooldown period to prevent repeated charges from the same trigger event in rapid succession. You also set a daily maximum savings amount during onboarding. These settings are locked for the duration of your vault period and may only be modified subject to the terms described in Section 5.3.

Financial Terms

4.1 Banking Partners

All savings accounts, fund custody, identity verification, and ACH transfers are provided by our licensed banking infrastructure partner. By using the Future You savings vault, you also agree to our banking partner's terms of service and privacy policy, which are presented to you during onboarding. Your savings account is subject to those terms in addition to these Terms.

Bank account linking and ACH transfer initiation are facilitated by our bank connectivity partner. By linking your bank account, you agree to that partner's end user privacy policy, which is presented to you during the bank linking process.

4.2 ACH Transfers

When a trigger fires, Future You initiates an ACH debit from your linked bank account for the configured trigger amount. ACH transfers typically settle within 1-3 business days. Future You and its partners are not responsible for:

• Overdraft fees or insufficient fund charges imposed by your bank
• Delays in ACH processing caused by your bank or the ACH network
• Failed transfers resulting from incorrect bank account information

You are responsible for maintaining sufficient funds in your linked bank account to cover trigger amounts. If a transfer fails due to insufficient funds, we may pause your triggers until the issue is resolved.

4.3 Minimum Transfer Amounts

Trigger amounts may be subject to minimum transfer thresholds as required by our banking partners. Any such minimums will be disclosed to you during trigger setup.

4.4 Withdrawal Processing

Vault withdrawals, including both scheduled unlocks and early withdrawals after the waiting period, are processed via ACH transfer to your linked bank account. Processing typically takes 3-5 business days from the date the withdrawal is approved. We are not responsible for delays caused by your bank or the ACH network.

5. Subscription and Fees

5.1 Subscription Plans

Future You offers the following subscription plans:

• Free: Access to simulated vault features with no real money movement. No charge.
• Premium: Full access to all features including real ACH transfers, Synctera savings vault, behavioral heatmaps, vault autopsy, and blackout mode. $4.99 per month or $39.99 per year.

Subscription pricing is subject to change. We will provide at least 30 days notice before any price increase takes effect for existing subscribers.

5.2 Billing

Subscriptions are billed through Apple In-App Purchase. Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. Subscription management and cancellation are handled through your Apple ID account settings. Apple's standard refund policies apply to all subscription purchases.

GS Digital LLC does not directly process or store your payment information. All billing is handled by Apple.

5.3 Vault Rule Modifications

Your trigger settings — including amounts, cooldown periods, and daily limits — are locked for the duration of your vault period to preserve the integrity of your behavioral commitment. If you need to modify these settings before your vault unlocks, a fixed modification fee of $1.00 will be added to your vault balance. This fee reflects the cost of changing a commitment you made to your future self.

5.4 Refunds

Subscription fees are generally non-refundable. We may provide refunds at our sole discretion in cases of verified technical malfunction or billing errors. Refund requests must be submitted within 30 days of the charge to support@future-you.net. Trigger deposits that have already been transferred to your savings vault are not refundable through Future You — they are your own funds held in your savings account and may be withdrawn subject to the terms described in Section 3.3.

User Responsibilities

By using Future You, you agree to:

• Provide accurate, current, and complete account and identity information
• Maintain the confidentiality of your account credentials and not share your account with others
• Notify us immediately at support@future-you.net of any unauthorized account access
• Maintain sufficient funds in your linked bank account to cover trigger amounts
• Keep your Apple Shortcuts automations active if you wish triggers to fire automatically
• Use the Service only for lawful personal purposes
• Comply with all applicable federal, state, and local laws

7. Prohibited Activities

You may not use Future You to:

• Engage in money laundering, fraud, or any other illegal financial activity
• Create multiple accounts to manipulate the system or circumvent account restrictions
• Deliberately manipulate trigger tracking systems to avoid charges
• Reverse engineer, decompile, or attempt to extract the source code of the application
• Use automated systems, bots, or scripts to interact with the Service
• Interfere with the proper functioning of the Service or its infrastructure
• Harvest, scrape, or collect data from the Service
• Impersonate any person or entity or provide false registration information
• Attempt to gain unauthorized access to any part of the Service or its related systems

8. Intellectual Property

The Service, including all content, features, functionality, design, code, trademarks, and branding, is owned by GS Digital LLC and protected by copyright, trademark, and other applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works based on any part of the Service without our express written permission.

9. Disclaimers

9.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9.2 No Financial Advice

Future You is a behavioral tool, not a financial advisor, broker, or investment adviser. Nothing in the Service constitutes financial, investment, tax, or legal advice. You should consult qualified professionals before making any financial decisions. GS Digital LLC is not responsible for any financial outcomes resulting from your use of the Service.

9.3 Trigger Accuracy

Trigger detection relies on Apple Shortcuts automations running on your device. We do not guarantee that all trigger events will be detected or that no false triggers will occur. Trigger detection may be affected by iOS updates, device settings changes, disabled automations, or other factors outside our control. We are not responsible for missed triggers or for financial outcomes resulting from trigger detection failures.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GS DIGITAL LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL SUBSCRIPTION FEES YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify, defend, and hold harmless GS Digital LLC and its officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or relating to your use of the Service, your violation of these Terms, your violation of any applicable law or regulation, or your violation of any rights of a third party.

Account Termination

12.1 Termination by You

You may terminate your account at any time through the app settings or by contacting us at support@future-you.net. Upon requesting account deletion, any funds held in your savings vault will be returned to your linked bank account after the applicable waiting period described in Section 3.3, subject to our banking partner's account closure procedures.

12.2 Termination by Us

We may suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent, illegal, or abusive activity
• Failure to complete identity verification
• Extended periods of inactivity
• At our reasonable discretion with reasonable notice where practicable

In the event of termination for cause, we will make reasonable efforts to return any funds held in your vault to your linked bank account, subject to applicable legal holds and our banking partner's account closure procedures.

Dispute Resolution

13.1 Informal Resolution

Before filing any formal claim, you agree to contact us at support@future-you.net to attempt to resolve the dispute informally. We will make good faith efforts to resolve any issues within 30 days of receiving your complaint.

13.2 Arbitration

If informal resolution is unsuccessful, any dispute, claim, or controversy arising from or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration will take place in Massachusetts. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.

You may opt out of arbitration by contacting us at support@future-you.net within 30 days of first agreeing to these Terms.

13.3 Class Action Waiver

To the extent permitted by applicable law, you waive any right to participate in a class action lawsuit or class-wide arbitration against GS Digital LLC.

13.4 Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles. Any legal proceedings not subject to arbitration shall be brought exclusively in the state or federal courts located in Massachusetts.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or in-app notification at least 30 days before the changes take effect. Your continued use of the Service after the effective date of any modification constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service before the effective date.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GS Digital LLC regarding the Service and supersede all prior agreements and understandings.

15.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

15.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
